Pada tanggal 31 Oktober 2013, seorang anak jenderal polisi bernama Anggara Putra Trisula (APT - 21 thn) marah tidak diijinkan menemui pacarnya pada jam sekolah tanpa meminta ijin terlebih dahulu ke kantor administrasi. Akibatnya dia dengan sengaja menabrak belasan siswa yang berada di sekitar mobilnya. Di antara belasan korbannya, yang paling

parah adalah Alif Kurnia Safitri (15 thn). Dia dilindas ban depan belakang sehingga harus dioperasi sesegera mungkin untuk menghindari cacat seumur hidup. Saat ini korban sudah tidak menggunakan kursi roda namun masih masih belum bisa berlari karen belum pulih seratus persen. Untuk kejadian ini, pelaku dan keluarga menyikapinya dengan sangat tidak simpatik.
Kronologi kejadian DI-MARI
PROSES HUKUM

Penanganan polisi terlihat sangat lambat. Tidak saja pelaku dan barang bukti baru didatangkan pada H+4, namun juga dalam hal penanganan berkasnya. Baru setelah Diskum Lantamal V yang menaungi Yayasan SMA HT2 menulis surat kepada Kapolda Jatim, Kapolres Sidoarjo dan keluarga pelaku pada tanggal 17 Desember 2013 (H+47) akhirnya keluar status SP21 untuk berkas kasus ini pada tanggal 21 Desember 2013 (H+51). Ketiga surat Diskum Danlantamal V tersebut mendesak kepada (i) Kapolda untuk memproses kasus tanpa campur tangan, (ii) Kapolres untuk mendesak keluarga korban penggantian biaya pengobatan korban, dan (iii) orang tua korban untuk datang minta maaf kepada pihak sekolah HT2 dan para korban beserta keluarga korban.
Penjelasan pihak kepolisian mengenai lambatnya proses penyelesaian berkas ini karena berkas sebelumnya telah dikembalikan oleh Kejaksaan pada tanggal 20 November 2013 (H+20) karena masih harus dilengkapi oleh:
1. Hasil visum yang diserahkan belum lengkap. Justru hasil visum dari korban yang terparah yang belum diserahkan(?),
2. Kekurangan alat bukti, seperti tidak disertakan sket (denah) kejadian dan keterangan saksi(?),

3. Pasal yang dikenakan kurang lengkap. Pada berkas yang pertama, pelaku hanya dijerat pasal 351 dan 360 KUHP. Kejaksaan minta agar pelaku pun dikenai pasal UU Lalu Lintas pasal 310 dan 311 UU Nomor 22 Tahun 2009 tentang lalu lintas karena ada unsur kelalaian yang menyebabkan orang lain luka.
SATU BULAN sejak status P21 diberikan untuk berkas perkara, belum ada “gerakan” apa-apa lagi dari pihak Kepolisian maupun Kejaksaan. Hal ini disebabkan karena penyerahan berkas tahap kedua dan pelaku belum dilakukan oleh pihak Kepolisian tanpa alasan yang jelas. Dan itu mengakibatkan pihak Kejaksaan tidak bisa memproses kasus ini lebih lanjut dan menetapkan kasus ini sebagai P22.
Akhirnya pada tanggal 29 Januari 2013 keluar pemberitaan resmi dari pihak Kejaksaan bahwa meskipun di pertengahan minggu sebelumnya mereka telah mengirimkan kepada Kepolisian mengenai pelimpahan tahap dua, namun hingga saat itu pihak Kepolisian belum juga memenuhinya. Menurut pihak Kejaksaan, batas waktu dari pelimpahan tahap 2 adalah 30 hari sejak status P21 diberikan. Karena itu status P21A diberikan untuk berkas kasus ini.
Pernyataan dari Pihak Kejaksaan ini dibenarkan oleh Pihak Kepolisian yang mengatakan bahwa dalam waktu dekat akan mereka serahkan.

Kasus ini bukan semata-mata kasus penyelewengan wewenang pejabat, agan2/wati. Kasus ini dilakukan dengan sengaja dan juga menginjak-injak kemanusiaan.
Lihatlah agan2/wati, begitu banyak kasus-kasus yang menginjak-injak kemanusiaan dan dengan arogansinya menggunakan wewenang dari jabatan/pengaruh yang dimiliki oleh atau keluarga atau kolega. Lihatlah pembelaan mereka. TIDAK ADA YANG MERASA BERSALAH SEDIKITPUN!!!
Apakah kita mau hal seperti ini terus berlangsung di Indonesia? Apakah kita mau ditindas oleh orang-orang yang menamakan diri mereka sebagai abdi masyarakat? Bukankah para pejabat yang menyalahgunakan wewenang mereka adalah manusia-manusia yang benar-benar tidak mengenal malu? Mereka digaji oleh rakyat, dan dengan jabatan yang dipercayakan kepada mereka kemudian mereka menginjak-nginjak rakyat.
Ane yakin agan2/wati tidak mau hal ini terjadi terus.

THE ACCIDENT
It happened on Oct 31, 2013, in Sidoarjo, East Java, Indonesia, when a young man named Anggara Putra Trisula (21 yo) came to Hang Tuah 2 (HT2) Highschool to visit his girlfriend who studied there.
Like most schools in Indonesia, HT2 also has rules regarding visitors to the school, one is where visitors acquire permission from the administration office before entering school premises. On that day, the security guard asked Anggara to first go to the administration office before seeing his girlfriend. Since Anggara refused, the security guard barred him from entering the building. Many pupils simply watching as both men were involved in an argument, but Aji, came over and confirmed the rule to Anggara. This made Anggara even more upset.
He went to his car and started the engine. First he drove his car forward slowly, then quickly did a reverse with high-speed. In doing so, he hit more than ten pupils who happened to stand nearby. Ignoring the commotion behind him, Anggara drove his car forward with high-speed again, and drove into an administration school officer and six other pupils. The officer’s left leg was merely broken in two places, but one pupil (Alif Kurnia Safitri – 15 yo) was virtually driven over by the left side of the car. Her fingers and toes, ribs, tailbone and pelvic bone were all broken.
The victims were later taken to the hospital, at which Alif had to go through emergency surgeries to avoid permanent damages. During her stay at the hospital, not once did Anggara or his family visited. Nor were there any apologized expressed. They only sent messengers three times to the hospital and once to Alif’s house.
INVESTIGATION PROCESS
Anggara is a general police officer’s son . Even though Anggara's car number plate was identified by the school's CCTV camera during the incident, which was reported to the Sidoarjo's police department on the same day. Nothing was heard of from the police department until the media exposed the incident and pressed for action. On the third day, a communique from Sidoarjo's police chief stated in defense that they were giving Anggara some time to recover from his distress due to the incident. They also added that the event did not render immediate action due to its insignificance: it was a simple misdemeanor and a petty crime. The chief mentioned that he sympathized with Anggara's troubles.
The statement brought in an avalanche of reaction from the media, which presumably was why Anggara was then summoned to the police office the next day. He brought along an entourage: his dad (Totok Sudharto), his dad's friend (Untung S Rajab, a former Chief of Provincial Police), his brother and his girlfriend. The police claimed that Anggara sat alone during the interrogation while the others waited in another room. But according to eyewitnesses, his brother and his girlfriend sat all together in the interrogation room as well, and Anggara with his girlfriend were free to come in and out as they wished. Afterwards, he went to jail that night.
On the next day (D+5) – after only spent one night in jail -- Anggara was taken to a hospital because he claimed he had lost appetite and had sleeping problem in jail. After he recovered at the hospital and was then assessed by a psychiatrist. Anggara went back home. His family requested to have him spend time at home instead of in jail, and this was approved by the police. The psyachiatrist concluded that he is immature for his age but, in this case, is capable to fulfill his obligations.
FOLLOW-UP ACTIONS
More than a month after Anggara was interrogated, hospitalized and went back home, there was no update on this case. No remorse to Alif -- the girl that suffers severe injuries from Anggara's car-- and her family was expressed, neither was any apology communicated to the school or the victims. Alif's hospital expenses reached USD6,000 and has not been recompensed. Anggara's family did give USD100 for medical check up transportations expense and a wheelchair. At one point Anggara's father phoned Alif's father to complain about one of Alif’s disappointed tweets which -- in his opinion -- has cornered his son and family.
The HT2 school is owned by The Indonesian Navy Foundation. So on Dec 17, 2013, D+47, the foundation wrote three letters. The first one was addressed to East Java Police Office urging them to proceed the case fast and fairly without intervention to process the case speedily and is free from any outside interference; the second to Sidoarjo's police department so that they would push Anggara's family to fulfill their obligation to recompense the hospical cost for all the victims; the last one to Anggara's family to show their remorse and to express their regrets to the school and the victims' families.
After those letters sent, finally on D+51, Dec, 21, 2013, Anggara's case was finally accepted by the general attorney office after being rejected several times due to lack of evidence and supporting documents (i.e. hospital visum report, pictures etc). Anggara and his parents also came to HT2 to formally meet the school's principal, the victims and their parents. But according to some people, Anggara and family showed cold response when Alif told them about her suffering.
LAST UPDATE
Today (Jan 13, 2014, D+74), there is *still* no action from the general attorney office. We do hope they are still preparing to conduct the trial, although one cannot help suspecting that this slow process is because Anggara's father had worked in the police department and still knows many people there.
Latest news: On January 21, 2014 -- one month after case file was stated complete (P-21) by General Attorney Office --> there was news in Jawa Pos that:
--> General Attorney Office could not do any follows up for this case since the file and Anggara haven't been submitted by Sidoarjo Police Department (???)
SO,
--> on what base then the file had been stated as P-21 on December 21 2013?
This finding was so confusing for people like us who don't understand law in detail. Is this a game between Police Department and General Attorney Office because of interfere from that family? Only God know...
THE PETITION
While awaiting the execution of the case, we have made a petition in CHANGE.ORG urging the Chief of Indonesian Police to make sure the case moves speedily and is free from any outside interference. For this we need signatures as many as possible, but obviously, the more the better.
